9 Legal wrongs to avoid concerning children in Nigeria
1
Don't buy land or property in the name of a child below 21 years.
A child under 21 cannot legally execute land documents under the Land Use Act and most state laws.
If you buy in a minor's name, you create problems of trusteeship and you can't sell or manage it without a Court order.
Rather, buy in your name and write a WILL or prepare a Deed of Gift instead.
2
Don't use a child as your Next-of-Kin
Next-of-Kin is an adult who can take decisions when you are incapacitated and during emérgencÃés.
A child below 18 years cannot sign bank forms, give medical consent, or process your benefits.
Use a responsible adult and make provision for the child in your Will.
3
Don't put a child as director, trustee, guarantor or surety.
A person under 18 cannot be a director of a company.
A child also cannot stand as surety for loan, bail, or rent. It is void.
4
Don't open or use a child's bank account for your business.
That is financial abúsé under the Child Rights Act. If anything goes wrong with your business, EFCC or your creditors can flag the child's account, and you can be accúséd of money laundering.
5
Don't employ or use a child for domestic help / hawking / begging.
This is child labour and child exploitation under various laws and punishable with up to 10 years imprisonment.
6
Don't include a child in oath-taking, juju, or shrine activities.
Subjecting a child to harmful traditional practice, oath, or ritual is illegal.
7
Don't béà t or physically púñish a child to the point of injury.
The Child Rights Act prohibits torture, degrading treatment, and child abúsé.
"Correcting" a child does not include caning to cause wound, fracture, or using wire, belt etc. You can be charged for assà últ.
8
Don't use your child to fÃght your spouse during divorce / separation.
Using a child to deny the other parent access without court order is parental alienation. Courts in Nigeria frown at it and it can affect your custody judgement.
9
Don't take or publish indecent pictures/videos of a child.
Posting nà kéd or séxualÃzed content of a child, even as a joke, is child pórñógraphy under the laws and comes with over 10 years imprisonment.
