What Happens When The Land Seller Diès Before Signing The Title Transfer Documents?
You have successfully paid for the land.
The sale of land agreement has been prepared.
All of sudden the seller diēs before executing the Deed of Assignment.
What is the right thing to do in such a situation?
The fact still remains that ɗêath cannot cancel the transaction when payment has been made.
Provided that both parties acted in good faith and no element of fruãd
In law, when a person is lãte, the law makes provision for the executors of his or her Estate where there is a Will or Administrators where there is no Will.
Picture the subject matter this way
Mr. A sold land to Mr. B. and received full payment for the land and Mr. B even took possession. Before they could execute the Deed of Assignment, Mr. A pãssed on.
In such a situation, Mr. B. Can approach the personal representatives to complete the transaction or refund the money where necessary.
However Mr. B needs to prove the existence of the transaction through the sale of land agreement, receipt or witnesses. Remember Law works with evidence and a deãd man cannot speak but evidence can.
So Yes, dêath of any of the parties cannot cancel the sale.
In addition to the above, prepare the transfer documents promptly.
Keep evidence of the transaction.
And conduct due diligence before payment.
