Which Force has the power to arrest someone

Police, DSS or EFCC — Who can Arrest you without a Warrant?

This is one question many people get wrong.

You hear:

“Police arrested him.”
“DSS came for him.”
“EFCC picked him up.”

Then somebody will confidently say:
“They cannot arrest you without a warrant!” 😂

But is that actually true?

Not always.

Let me break it down in simple English.

🥢 The Police

Yes, the Police can arrest a person without a warrant in circumstances permitted by law.
For example, where the officer finds the person committing an offence or reasonably suspects that the person has committed, is committing, or is about to commit an offence in circumstances covered by the law. The Police Act also provides other circumstances where a warrantless arrest may be made.

BUT…
A police uniform does not mean:
“Arrest anybody anyhow.” 😂

A civil disagreement does not automatically become a criminal offence.

If your neighbour owes you money, that does not automatically mean the Police should become your debt recovery agent.

If two business partners are fighting over a contract, that does not automatically turn the matter into a criminal case.
Police powers are broad, but they are still controlled by law.

🥢 DSS (Department of State Services)

The DSS is not simply “another Police station.”
Its statutory functions are primarily connected with internal security, including the prevention and detection of threats such as terrorism, espionage, sabotage, subversion and other matters affecting national security.

So if DSS becomes involved in a matter, the first question should be:
What offence or security issue is being investigated?

It is wrong to assume that DSS has unlimited power to arrest anybody for anything.
Their powers also operate within the law governing the Service.

🥢 EFCC (Economic and Financial Crimes Commission)

Now to EFCC. EFCC deals with economic and financial crimes. Fraud, money laundering,
financial crimes, Corruption-related offences.
Advance fee fraud and other offences within its statutory mandate.

And there is an important point many people don't know

Under the EFCC Act, an EFCC officer investigating or prosecuting a case under the Act has the powers and immunities of a Police Officer under the Police Act and other applicable laws. So “EFCC cannot arrest without a warrant” is not a safe blanket statement.
But neither does EFCC have a licence to arrest people simply because someone is angry with them.

So here is the Part I want you to remember

No Warrant is not automatically Illegal arrest.

And

No Uniform is not automatically lawful arrest.

The real question is:

👉 What law gives the agency the power to arrest?
👉 What offence is the person suspected of committing?
👉 Were the legal conditions for a warrantless arrest satisfied?
👉 Were the person's constitutional rights respected?

That is why you should be careful when somebody tells you:
“They cannot arrest you without a warrant.”

Sometimes they can.
Sometimes they cannot.
It depends on the law and the circumstances of the arrest.

Save this post.
Because the day an agency knocks on your door, shouting “Come with us!”, is probably not the best day to start Googling your rights. 😂

Ignorance of the law is not an excuse.
